Terms and Conditions – 2nd Hand Bargain

These terms and conditions apply to all orders, purchases and use of the online store of 2nd Hand Bargain.

2. Applicability

These terms and conditions apply to every offer by 2nd Hand Bargain and to every agreement concluded via the online store.

By placing an order or submitting a bid, you agree to these terms.

3. Products

2nd Hand Bargain sells second-hand and/or outlet products. We do our best to describe and present all products as accurately as possible.

As items may be second-hand, light signs of use may be present. Any visible defects are mentioned as much as possible in the product description.

Obvious errors or mistakes in the offer are not binding on us.

4. Prices

All prices in the online store are listed in euros (€) and exclude VAT. 2nd Hand Bargain falls under the Small Business Scheme (KOR) and is therefore exempt from VAT.

Shipping costs are clearly displayed during the checkout process.

2nd Hand Bargain reserves the right to adjust prices at any time.

5. Orders and agreement

An agreement is concluded once your order has been confirmed by email.

We reserve the right to refuse or cancel an order, for example in cases of:

suspected fraud;
incorrect price information;
stock issues;
incomplete data.

5a. Bids

On selected products we offer the option to submit a bid. A bid is non-binding and does not obligate the buyer to purchase.

2nd Hand Bargain reserves the right to accept, reject or make a counter-offer without stating a reason.

An agreement is only concluded after explicit written acceptance of the bid by 2nd Hand Bargain, confirmed by email.

Accepted bids must be paid within 3 business days. In the event of non-payment within the deadline, the assignment lapses and the product may be relisted.

6. Payment

Payments are processed via the payment methods available in the online store.

The order is only shipped after payment has been successfully received.

7. Shipping and delivery

We strive to ship orders as quickly as possible. Stated delivery times are indicative and no rights can be derived from them.

If delivery does not take place within 30 days of the confirmation date, you have the right to dissolve the agreement free of charge and claim a full refund.

2nd Hand Bargain is not liable for delays caused by carriers or force majeure.

The risk of damage or loss transfers to the customer once the package has been delivered.

8. Return policy

You have the right to request a return within 30 days of receiving your order.

Conditions for returns

To be eligible for a return: info@2ndhandbargain.nl

the item must be in the same condition as when you received it;
the item must not have been used or damaged;
the item should preferably be in its original packaging.

Requesting a return

Returns must be sent to the following address:

Return costs

The customer is responsible for:

arranging the return shipment;
the costs of return shipping.

Refund

After receiving and inspecting the returned item, we will let you know whether the return has been approved.

If approved, the purchase amount will be refunded within 14 days via the same payment method.

9. Damaged or incorrect items

Please check your order immediately upon receipt.

an item is damaged;
an item arrives defective;
you have received the wrong item.

We will then work together to find an appropriate solution.

10. Exchanges

We do not offer a direct exchange service.

Would you like to receive a different item? You can:

return the current item;
place a new order once the return has been accepted.

11. Right of withdrawal in the EU

For consumers within the European Union, a statutory cooling-off period of 14 days applies.

Within this period, you may cancel or return your order without stating a reason.

Conditions:

the item must be unused;
fitted with labels where applicable;
in its original packaging;
accompanied by proof of purchase.

12. Liability

2nd Hand Bargain is not liable for:

indirect damages;
consequential damages;
loss of data;
damages resulting from incorrect use of products.

Liability is always limited to the amount of the relevant order.

13. Privacy

Personal data is processed in accordance with our privacy policy and used solely for processing orders and customer service.

We treat personal data confidentially in accordance with applicable data protection legislation (GDPR).

14. Intellectual property

All content on the online store, including texts, images, logos and designs, remains the property of 2nd Hand Bargain and may not be used or copied without permission.

15. Applicable law

These terms and conditions are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.

For consumers within the European Union, the mandatory consumer protection law of the consumer's country of residence remains applicable at all times, regardless of the choice of law in these terms.
